By accessing Easy ACA Docs, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Easy ACA Docs. We reserve the right to modify these Terms at any time, and your continued use of the service constitutes acceptance of any changes.

2. Eligibility and Access

To use Easy ACA Docs, you must:

• Be a current or former member of a participating health system or employer group
• Provide accurate and truthful information for identity verification
• Be at least 18 years of age, or have a parent or guardian access documents on your behalf
• Have the legal right to access the requested tax documents
• Comply with all applicable federal, state, and local laws

We reserve the right to deny access to anyone at our sole discretion, particularly in cases of suspected fraud or unauthorized access attempts.

3. Service Description

Easy ACA Docs provides a secure online portal for members to access their ACA tax documents, including:

• Form 1095-B (Health Coverage)
• Related health coverage documentation required for federal tax filing

We do not provide tax advice, legal counsel, or guarantee the accuracy of information provided by participating health systems or employers. For questions about your tax documents, please consult a qualified tax professional or contact your health system directly.

4. User Responsibilities

As a user of Easy ACA Docs, you agree to:

• Provide accurate and complete information for identity verification
• Keep your access credentials confidential and secure
• Not share your documents with unauthorized third parties
• Only access documents you are legally entitled to view
• Not attempt to gain unauthorized access to the system or other users' information
• Not use automated tools, bots, or scripts to access the service
• Notify us immediately if you suspect unauthorized access to your account
• Use the service only for lawful purposes

5. Identity Verification

To protect your privacy and ensure secure access to sensitive tax documents, we require identity verification through personal information including your last name, date of birth, and the last four digits of your Social Security Number. You authorize us to verify this information with your health system or employer. Multiple failed verification attempts may result in temporary or permanent access restrictions. You are responsible for ensuring the information you provide is accurate and current.

6. Intellectual Property

All content on Easy ACA Docs, including but not limited to text, graphics, logos, software, and design elements, is the property of Easy ACA Docs or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. The tax documents you access remain the property of the issuing health system or employer and are provided to you for personal use only.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Easy ACA Docs is provided "as is" without warranties of any kind, express or implied
• We do not guarantee uninterrupted, error-free, or secure operation of the service
• We are not liable for the accuracy or completeness of tax documents provided by third parties
• We are not responsible for any damages arising from your use or inability to use the service
• Our total liability shall not exceed $100 or the amount paid by you (if any) for the service
• We are not liable for indirect, incidental, consequential, or punitive damages

Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Easy ACA Docs, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms, (b) your violation of any rights of another party, (c) your misuse of the service, or (d) any unauthorized access to your account resulting from your failure to maintain confidentiality.

9. Data Security and Privacy

We implement industry-standard security measures to protect your personal information. However, no method of transmission over the internet is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. Our collection, use, and disclosure of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for maintaining the security of any downloaded documents on your personal devices.

10. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue Easy ACA Docs (or any part thereof) at any time without notice. We may also terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

11. Prohibited Uses

You may not use Easy ACA Docs to:

• Violate any applicable laws or regulations
• Access documents you are not authorized to view
• Impersonate any person or entity
• Transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the service or servers
• Collect or harvest personal information from other users
• Use the service for commercial purposes without authorization
• Engage in any fraudulent or deceptive practices

12. Third-Party Services and Content

Easy ACA Docs may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. The tax documents provided through our platform are generated and maintained by participating health systems and employers. We do not verify, endorse, or guarantee the accuracy of third-party content.

13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Easy ACA Docs is headquartered, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the service shall first be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.

14. Document Retention and Availability

Tax documents are typically available for a minimum of seven years from the date of issuance, as required by IRS regulations. However, availability may vary based on your health system's policies. We recommend downloading and securely storing your documents for your records. We are not responsible for documents that become unavailable due to health system policies, technical issues, or service discontinuation.

15. HIPAA and Healthcare Information

Easy ACA Docs operates as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA) for participating health systems. We maintain appropriate safeguards to protect your Protected Health Information (PHI) in accordance with HIPAA requirements. By using this service, you acknowledge that your health coverage information will be accessed and displayed through our platform. This does not constitute a HIPAA authorization for disclosure of your medical records or treatment information.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Easy ACA Docs regarding the use of our service and supersede all prior agreements and understandings..
